PHOTOGRAPHY STUDIO RENTAL AGREEMENT

RENTAL TERMS

“The Avalon Studio/Premises” includes the studio, restroom facilities, and parking areas owned by The Avalon Studio; “Photographer/Client” is the person or entity renting Premises and/or equipment.

PAYMENTS & DEPOSITS

In order to confirm and hold a reservation, all rental fees must be paid in full at the time of booking. In the case of additional equipment rental added on the shoot day, the rental fee plus damage deposit must be paid by credit card at the time of rental.

PARKING INFORMATION

Please park in front of the studio door (we have 2 parking spots labeled "The Avalon Studio"). If those parking spots are taken please park in front of "Pristine Auto Line" parking.

CANCELLATIONS

No refunds on canceled appointments by Photographer/Client!

RESCHEDULING

In the event that you need to reschedule your booking, a $9.99 rescheduling fee will be charged & you will have up to 24 hours to reserve your new date/time. After the 24 hours, you will no longer be able to reschedule the booking.

STUDIO RULES

• Maximum of 10 people in Photographer’s/Client’s party. Ask ahead if you have a larger group.

• Food and drink must stay in areas with hard floors, not in white floor. If you have drinks on the round coffee table, please use coasters!

• Furniture is not be be dragged on the floor. 2 people will move furniture. Neutral arches do NOT get moved.

• Photographers & anyone not getting their photos taken must wear plastic covers on their shoes during their session.

• Big seasonal decor items are not to be moved unless you request.

• Music/voices are to be kept at reasonable levels and not contain vulgar or offensive lyrics or words.

• No one is allowed in the production room in the rear of the facility (not referring to the coffee/lounge room).

• No boudoir sessions allowed in the studio.

• No pets allowed without prior consent of an Avalon Studio representative.

• No smoking whatsoever is allowed in the building or within 20 feet of any entrance.

OVERTIME FEES

For every 15 minutes that the Photographer/Client stays past the scheduled booking, they will be charged a $25 overtime fee. An invoice will be made out to the Photographer/Client that booked the corresponding studio rental.

         If the Avalon Studio must cancel Photographer’s/Client’s reservation, Photographer/Client will be given, in Avalon Studio’s sole discretion, either rescheduling priority or a full refund. Avalon Studio is not liable for acts out of its control that affect the shoot, such as building equipment failures, power outages, weather, acts of God or emergencies.

LENGTH OF USE

Rental periods are pre-arranged at the time of booking. Photographer’s/Client’s rental time begins promptly at the designated starting time and ends promptly at the designated ending time. Time includes set up and break-down. Studio must be cleaned and vacated by the end of the rental period. No prior drop-off and/or pick-up after completion of shoot, of equipment, props, etc. unless notified at time of rental contract. Additional fees may apply. Early or extended hours must be worked out and paid for in advance before the rental period begins.

CLEANING & TRASH

Photographer/Client agrees to leave the Premises and all contents and fixtures in the same condition as they were when Photographer/Client arrived. Avalon Studio will dispose of trash collected in the supplied trash cans. All items brought to the Premises by Photographer/Client are to be removed by Photographer/Client. Items left after 7 days will be assumed abandoned and may be discarded or kept by the Avalon Studio for Avalon Studio use, with no compensation due the Photographer/Client, at the discretion of the Avalon Studio. If Photographer/Client does not return Premises to the order and cleanliness found when Photographer/Client arrived, Avalon Studio will charge at minimum a $50 cleaning fee to be withheld from the cleaning/damage deposit.

WAIVER OF LIABILITY

Use of Avalon Studio’s Premises and equipment is at Photographer’s/Client’s risk. Photographer/Client hereby agrees that Avalon Studio WILL NOT be held liable for any direct, indirect, incidental or consequential damage, injury or loss to Photographer/Client, his/her party or possessions while on the Premises. Photographer/Client holds harmless and indemnifies The Avalon Studio and its owners, agents, representatives, associates, officers, employees, guests and tenants against any suit, claim, loss, accident, judgment, fine, injury or damages, including reasonable attorney’s fees. This indemnification shall continue in full force and effect during and after the term of the rental for such causes arising during the term of the rental.

CONDUCT

This is a shared studio and we maintain a professional environment. Photographer/Client shall be solely responsible for the conduct and welfare of all persons accompanying Photographer/Client while on The Avalon Studio’s Premises. Photographer/Client agrees that The Avalon Studio’s representative may, at The Avalon Studio’s sole discretion, be present at all times. If the representative observes or otherwise becomes aware of dangerous, illegal or negligent practices or activities, the representative reserves the right to stop the shoot and may require Photographer/Client and Photographer’s/Client’s party to leave immediately. The authorities will be alerted to any illegal activities witnessed by The Avalon Studio’s representative. In such case no refund will be given for unused time. However, The Avalon Studio and its representatives assume no responsibility to act in such cases.

AGE OF MODELS

Photographer/Client is solely responsible for verifying that all photographic subjects are of legal age or accompanied by a parent or legal guardian.  The Avalon Studio has no responsibility to determine or verify the age of participants in the Photographer’s/Client’s activities but reserves the right to demand proof of parental consent if models or photographic subjects are under the age of 18 and to end those activities if The Avalon Studio becomes aware that legal age violations are occurring.  The Avalon Studio is not liable in the case of an invalid ID or any other form of age verification.

PHOTO RELEASE

Photographer/Client agrees to allow The Avalon Studio to post, share, and use any photos taken on the Premises. Any photos used for marketing purposes, websites, and social media are allowed by both Photographer/Client to release to The Avalon Studio. 

EQUIPMENT

The Avalon Studio agrees to provide equipment in good working order, but makes no special guarantees as to said equipment’s functionality or suitability to Photographer’s/Client’s purposes. Photographer/Client shall notify The Avalon Studio immediately of any malfunction, damage or other issues with the equipment. There is no studio phone service provided. Photographer/Client is advised to bring a cell phone. WiFi internet service is not available during the rental period. 

DAMAGE/CLEANING FEE

Photographer/Client shall be solely responsible for any damage to The Avalon Studio’s property or equipment that occurs during the time Photographer/Client or his party occupies the Premises. Damage fee will be charge at the end of the booking. Photographer/Client agrees to pay for damage to the Premises including spills, excessive wear, marks or stains on furniture, fixtures or painted surfaces.

MISCELLANY

Photographer/Client shall comply in all respects with all federal, state, county, city, or other local laws, regulations and ordinances and all rules and regulations of any governmental authority, in connection with this Agreement. This Agreement incorporates the entire understanding and agreement between The Avalon Studio and Photographer/Client. Any modifications of this Agreement must be in writing and signed by both parties. Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this Agreement. The laws of the State of Missouri shall govern this Agreement. The following signatures constitute a legal and binding Agreement between Photographer/Client and The Avalon Studio.

The Avalon Club - Studio Membership Terms

With the 4 hour, 6 hour, and 8 hour studio memberships, we offer is perfect for those who need a space to work on their creative projects and/or and to grow your photography/videography portfolio. With this membership, you will have access to our studio for X hours per month (depending on the package you choose).

  • They can be used all at once or spread out over the course of the month.

  • Please note that the hours do not roll over at the end of the month, so it's important to use them within the allotted time. (Reservations of bookings should be made in the same month that you schedule them!)

  • A 2-month membership minimum is required & membership can be canceled any time after, if necessary.

  • All props and amenities are included with your booking. This means that you'll have access to everything you need to bring your creative vision to life. Whether you need lighting, backdrops, or other equipment, we've got you covered.

  • Our studio is equipped with comfortable seating, a bluetooth speaker, coffee bar and mini fridge, ensuring that you have a comfortable and productive experience.

    By becoming a member you agree to the Terms and Conditions:

Damage deposits will be held until repairs can be made. If the damage exceeds the amount of the damage deposit, Photographer/Client agrees to pay reasonable additional repair costs to bring damaged equipment back to working condition. Photographer/Client agrees to pay for damage to the Premises including spills, excessive wear, marks or stains on furniture, fixtures or painted surfaces.

    MISCELLANY
